1.2 – BUYER

The person who becomes a party to the sales agreement by registering on the website as a customer or by placing a product order is deemed to be the BUYER. The Seller relies on the address and contact information provided by the buyer.

ARTICLE 2: DEFINITIONS

BUYER: The natural person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes.
SELLER: RETAY MAĞAZACILIK A.Ş., which provides products/services to the consumer for commercial purposes.
LAW: The Law No. 6502 on the Protection of the Consumer.
REGULATION: The Regulation on Distance Contracts.

ARTICLE 3: SUBJECT OF THE AGREEMENT AND PRODUCT INFORMATION

This agreement covers the rights and obligations of the parties in accordance with Law No. 6502 and the relevant Regulation, with respect to the sale and delivery of the product ordered electronically through the SELLER's website. The type, quantity, sale price, and delivery information of the product are as specified in the order form.

ARTICLE 4: GENERAL PROVISIONS

4.1: The BUYER declares that they have read and confirmed the preliminary information regarding the essential characteristics of the product, the sale price, the method of payment, and delivery.
4.2: The product shall be delivered within the period stated on the website, provided that it does not exceed the statutory 30-day period. Orders placed by 14:30 on business days are shipped the same day; orders placed after 14:30 are prepared for shipment on the next business day.
4.3: The SELLER is responsible for delivering the product in sound, complete condition and in accordance with the qualities specified in the order.
4.4: If the product price is not paid or is cancelled in bank records, the SELLER is released from the delivery obligation.
4.5: If fulfillment becomes impossible, the SELLER shall notify the BUYER within 3 days and refund collected payments within 14 days at the latest.

ARTICLE 5: RIGHT OF WITHDRAWAL

5.1: In distance contracts relating to goods, the BUYER has the right to withdraw within 14 (fourteen) days from delivery without providing any justification.
5.2: To exercise this right, written notice must be given to the SELLER within this period and the product must not have been used beyond ordinary inspection.
5.3: The returned product must be complete and undamaged with its box, packaging, and standard accessories, if any.
5.4 – Cases Where Withdrawal Cannot Be Exercised: The right of withdrawal cannot be exercised for personalized products, products unsuitable for return for hygiene reasons, or products not suitable for return by their nature.

ARTICLE 6: DAMAGED PRODUCTS AND RETURNS

If the ordered products are damaged, the BUYER should refuse delivery and have a damage report prepared with the cargo official. Once the report and notice are submitted to the SELLER's communication channels, the necessary review is carried out and a refund or exchange is processed.

ARTICLE 7: PROTECTION OF PERSONAL DATA (KVKK)

The SELLER accepts and undertakes to process personal data obtained under this agreement in accordance with KVKK No. 6698 and to ensure its security. The BUYER is responsible for the accuracy of their information.

ARTICLE 8: COMPETENT COURT

Consumer Arbitration Committees are competent up to the value announced each year by the Ministry of Trade; above this value, Consumer Courts at the place of residence of the BUYER or SELLER are competent.

ARTICLE 9: ENTRY INTO FORCE

This agreement entered into force on the date it was approved electronically by the BUYER.
